South Carolina Prisoners not Entitled to Prevailing Wage at Prison Jobs
South Carolina state prisoners sued the state Department of Corrections in state court after they weren't paid a comparable wage to free worlders performing the same work for their participation in a prison industries program. The trial court dismissed because the prisoners weren't "employees" pursuant to SC Code Ann. § 24-3-430 et seq., and the prisoners appealed.
On appeal, the Supreme Court of South Carolina agreed that the prisoners weren't "employees" under § 24-3-430 et seq. On that basis, the trial court was affirmed and the appeal dismissed. See: Williams v. SC Department of Corrections, 641 S.E.2d 885 (2007).
