$5,000 Awarded To Canadian Prisoner Exposed To Second Hand Smoke

In 2005, a Toronto prisoner was awarded $5,000 by a Canadian federal judge who ruled Correctional Services of Canada (GSC) failed to provide Vlado Maljkovich with the legally mandated healthy environment while in the Fenbrook Correctional Institute in Gravenhurst. Judge Martha Milczynski found that "Fenbrook owed ... a duty of care ... to incarcerate (Maljkovich) in conditions that were healthful and that did not cause him to suffer physical discomfort and upset."
