$11,000 Paid in Illegal WA DNA Testing

McNeil Island Corrections Center Andre R. Goncalves filed a 42 U.S.0 §1983
action in the Western District of Washington federal court. The complaint
asserted Fourth Amendment claims for requiring him to give a blood sample
for DNA in the State's DNA database or be placed in segregation. The DNA
testing was illegal under State of Washington law at that time as Goncalves
was not convicted of a class A felony under the Uniform Controlled
Substances Act nor was he convicted of a violent or sexual offense. On
March 4, 1998, Goncalves settled the suit for $7,500 and $3,500 in attorney
fees as well as destruction of the blood sample and any test results
obtained there from. Goncalves was represented by Seattle attorney Fred
