$1,960 Awarded in Washington Public Records Suit

A Washington Superior Court, Thurston County, awarded Airway Heights
Correctional Center (AHCC) prisoner Michael Allen Holmberg $1,960 in costs
and penalties for the failure of the Washington Department of Corrections
(WDOC) to provide public documents he had requested. On July 19, 1999
Holmberg requested that AHCC Superintendent Kay Walter provide him with a
copy of the Special Classification Review conducted on May 17, 1999."
Walter responded on August 12, 1999, stating the requested documents would
be provided free of charge. However, by October 17, 1999 the documents had
not been provided and Holmberg filed suit.

Judge Tari S. Eitzen found the WDOC had failed to provide Holmberg access
to the requested documents until August 7, 2000, a total of 370 days, which
violated the five-day time limit imposed by the Public Disclosure Act. The
court awarded a penalty of $5.00 per day for the delay, for a total penalty
of $1,850. Holmberg was also awarded $110 in costs for filing the action.
