$200 Awarded To Prisoner Wrongfully Held On Keeplock Status

Osvaldo Solis, a prisoner at the Sing Sing Correctional Facility (SSCF),
filed a pro se law suit against SSCF, for wrongfully placing him on
keeplock status.

On April 14, 2001, Solis was placed on keeplock confinement for allegedly
taking part in an attack on another prisoner. Solis went to the
disciplinary hearing 11 days later and argued that he had nothing to do
with the attack and that he had an alibi, which was confirmed by an
instructor of the custodial maintenance school operated by the prison. The
disciplinary officer found Solis not guilty of the infraction based on the
testimony at the hearing.

On August 7, 2002, the New York, Court of Claims, held that prison staff
violated their own policy: 7 NYCRR 25.-5.1(a),(b), by failing to conduct
the hearing no later than 7 days after the confinement. The court awarded
Solis $200, at $50 per day, for every day over the 7 days of confinement
that prison officials had to hold the hearing. See: Solis v. State of New
