$221,000 Settlement For 8 Year Old Jailed In Alleged New Mexico School Misconduct
Misconduct
On April 17, 2006, Angela Esquibel, the mother of 8 year old Jerry
Trujillo, was awarded $221,000 in a Federal civil rights complaint filed
against New Mexico school and jail officials for arresting and
incarcerating her son on an alleged disorderly conduct charge. Trujillo
allegedly hit another child with a basketball, refused to return to his
classroom, and was threatened with arrest. Trujillo's mother filed her
complaint claiming due process violations because her son was arrested,
booked, and incarcerated in an adult jail facility, where he was taunted
and cursed at by inmates in other cells, causing him to suffer from
nightmares and emotional distress. See: Esquibel v. Archuleta, US DC, D NM,
Case No. Unknown.
