$500 Award in Failure to Protect NY Prisoner from Assault

William Blake, Jr., a prisoner at the Sullivan Correctional Facility (SCF),
filed a pro se law suit against SCF, for failing to prevent another
prisoner from assaulting him, in SCF's Special Housing Unit (SHU).
In November 1998, a prisoner reached out of his feed-up hatch" and cut
Blake across the neck, while he was being escorted to the shower area in
the SHU. Blake suffered a laceration and residual scar to his neck as a
result of the attack. On January 29, 2002, the New York state Court of
Claims held that the policy of the SHU was to keep the feed-up hatch locked
at all times, and that only a prison guard could have left it open.
Therefore the state was negligent in leaving the hatch open which resulted
in Blake's injuries. The court awarded Blake $500, in damages for his
