$500 Paid in NY Prisoner Medical Negligence Claim.

Willie Sykes, a Sing Sing Correctional Facility prisoner at the time of
trial, complained of pain in his heels at Downstate Correctional Facility,
and staff advised him to see a podiatrist when he got to the next
facility. Ten days later he arrived at Sing Sing and advised medical staff
of his pain at an initial assessment. He was not seen by a podiatrist for
six months. He sued for the delay of treatment, which amounted to
cortisone shots.

The court ruled Sykes failed to sustain a claim for medical malpractice
but found he did establish a claim of simple medical negligence, as the
court was "convinced that some degree of pain might not have been avoided
by use of such palliative care. The Court awarded Sykes $500 for his pain
and suffering. Sykes acted pro se. See Sykes v. State of New York, Court
of Claims, White Plains, Claim No. 101309.
