California State Prisoner Assaulted By Guards Awarded $2,500

On May 18, 1993, a federal jury in San Francisco awarded $2,500 to a
prisoner who claimed he was assaulted by prison guards.
Plaintiff Scott Felix, 30, alleged that in March 1985 while incarcerated at
the Folsom State Prison he was assaulted by two prison guards. Felix
claimed that as a result of the assault, which was partly in retaliation
for his relationship with a female guard, he suffered emotional distress as
well as bruising and abrasions to the head and shoulders.
Felix sued the guards claiming that they violated his civil rights by using
excessive force and physically assaulting him. Felix also sued the
commissioner of corrections and the guards' supervisor alleging liability
under the doctrine of respondeat superior.

The court issued a directed verdict as to one of the prison guards and
granted summary judgment as to the commissioner. Felix prevailed on his
claim against the second guard and was awarded $2,500.

Felix was represented by Randall G. Knox of San Francisco and John P.
Halfpenny, Frank M. Hinman, and Alfred C. Pfeiffer, Jr. of the San
Francisco firm McCutchen, Doyle, Brown and Enersen. See: Felix v. McCarthy,
USDC ND CA, Case No. C 85-8777.
