Massachusetts Prisoner Beaten By Guards Awarded $21,000

In August 1997, a court in Suffolk County, Massachusetts, awarded $21,000
to a state prisoner who was severely beaten by prison guards.

The plaintiff prisoner claimed that while imprisoned in May 1991 he was
shackled, handcuffed, kneed, and spat on by a prison guard as at least six
other guards looked on without intervening. The prisoner, then 24, suffered
fractures to both sides of his jaw, a broken tooth, contusions to his face
and forehead, and a bruised and swollen left eye. In his suit, filed in
April 1996, the prisoner claimed the guards were negligent for illegally
assaulting him, using excessive force, and failing to prevent the illegal
assault. He also claimed the guards were not properly trained, supervised,
or disciplined.

The defendant guards contended the prisoner provoked them. The award
included $12,000 for pain and suffering and $9,000 in other damages. See:
