Meningitis Death In Racine County, Wisconsin, Jail Settles For $383,000

According to a report published by Wisconsin Jury Verdicts on November 1,
2004, a lawsuit involving the death of a 21-year-old prisoner it the Racine
County Jail settled for $383,000.

From the sketchy details in the case, the prisoner apparently complained of
ear and neck pain while in the jail and was given a decongestant, an
antihistamine, and Tylenol. He was later seen by a doctor and given
antibiotics and ear drops. The ear pain continued into the next day, and he
became nauseous and started vomiting.

The prisoner was taken to the hospital and given fluids. It is unknown what
other treatment he received, but his temperature was recorded as 103
degrees. Upon his return to the jail, probably the same day, he reportedly
collapsed in his cell and was for some reason placed in segregation. When
jailers checked on him later that evening he was already dead. Meningitis
was determined to be the cause of death.

The estate sued under 42 U.S.C. § 1983 claiming the defendants were
deliberately indifferent in violation of the Eighth Amendment. The case
settled prior to trial for $383,000. Attorney Willie Nunnery of the Nunnery
Law Offices in Madison, Wisconsin, represented the estate. See: Myers v.
Racine County, Court unknown, Case No. 02C-1276.
