Nevada Supreme Court Upholds Segregation of HIV-Positive Prisoners
his federal civil rights claim that he should not be segregated from other
prisoners because he is HIV-positive. The Nevada Supreme Court held that
Lepley's complaint "did not state a claim for deprivation of any right
guaranteed by the constitution or other law." The Court further held that
segregation of HIV-positive prisoners is rationally related to the
legitimate government purpose of limiting the virus' spread. See: Lepley v.
Warden, No. 44742 (Nev. Spreme Court, October 21, 2005).
