Ohio Prison Liable For Loss Of Prisoner Property

Ohio State prisoner Kevin Scudder filed a State court action against the
State Department of Corrections to recover the estimated replacement cost
of property lost after delivery to the prison. Scudder's son and a church
official sent a package to him at the prison containing a gold cross and
chain valued at seventy-three dollars.

The trial court found the prison negligent regarding loss of the property
but limited damages to Scudder to twenty dollars, the maximum allowable
under prison policy restrictions. The Court further held that Scudder
failed to produce any statements from his son or the church official
regarding the purchase price of the lost property or any sales receipt
evidencing such value. The Court also awarded Scudder twenty-five dollars
