Undisclosed Settlement in Arizona Mistaken Identity Arrest

Tiburcio Serna Galvan was an agricultural worker when he was arrested in August 1995 in the state of Washington on an Arizona narcotics/traffic warrant. Prior to his arrest, his wallet and identification was stolen.

After he was transported to Arizona's Maricopa County Jail, he was appointed counsel who never saw him for 3 months. A month later, it was learned Galvan's arrest was a case of mistaken identity.

Galvan sued his attorneys from the law firm of Victor and Bartolomei for failure to contact him and negligence. They admitted negligence. The case settled during trial for an undisclosed amount. See: Galvan v. Victor, Arizona Superior Court, Maricopa County, Case No CV 96-16270.
