WA Guards Enjoined From Opening Legal Mail Outside Prisoners' Presence

Ralph Fourmont is a prisoner at the Washington State Penitentiary (WSP) in
Walla Walla. After WSP mailroom guards opened his legal mail outside his
presence, he sought a preliminary injunction in a federal district court.
The court enjoined anyone acting as supervisor of the WSP mailroom from
opening mail readily identifiable as legal mail outside the inmate
addressee's presence.

On appeal, the U.S. Court of Appeals for the 9th Circuit found that the
district court was within its discretion when it issued the injunction. It
then affirmed the district court's imposition of the same. See: Fourmont v.
Warneka, 995 F.2d 231 (9th Cir. 1993) (unpublished).
