Washington DOC Pays $3,000 for Failing to Timely Disclose Public Records

The Washington Department of Corrections (WDOC) agreed to pay
$2,997.50 to settle a lawsuit under the Public Disclosure Act brought in a
Washington Superior Court, Thurston County, by the International
Brotherhood of Electrical Workers Local Union No. 76 (IBEW). IBEW sent a
letter to WDOC on June 23, 1999, requesting a list of equipment and
material provided by Twin Rivers Electrical Supply and submittals for the
Stafford Creek Correctional Facility Project, including the total cost of
all services provided to date. Additionally, IBEW sought a listing of
material and equipment provided by Enertron Electrical Contractors for the
same project, again including the total cost of all services provided.
In response, IBEW received a letter dated July 1, 1999, stating the
request had been forwarded to the proper staff. On August 17, 1999. IBEW
advised WDOC it still had not received the requested information. On
December 22, 1999, IBEW wrote another letter asking the WDOC to comply
with the requests for disclosure. On March 27, 2000, IBEW filed suit
because it had received no response, disclosure or denial to its requests.
On May 23, 2000 the WDOC agreed to disclose the requested records and pay
$2,997.50 in costs, attorney fees and statutory awards to settle the
suit. IBEW was represented by David Hannah and Anne Sinter of the
Rinehart, Rubblee & Hannah law firm in Seattle. See: International
