Virginia Police Department Record of Criminal Case Disposition Not Subject to Public Record Request

The Attorney General of Virginia has opined that a city police department that maintains a record of all persons tried in municipal court of the city for whether the party was convicted or acquitted, and the ultimate disposition of the matter is not required to allow public inspection of those records.

It was felt that since the records are kept for purposes of prosecution of criminal cases, only persons with a bona fide interest to them should be allowed to inspect those records. Since the Court maintains the records; the person seeking inspection should be referred to the Court. See: 1962 Va. AG Lexis 149
