All Plaintiffs Must Sign Motion to Amend Complaint

A prisoner may be denied leave to amend a complaint before responsive pleadings are filed where co-plaintiffs have not joined in the motion. The plaintiff said that he relied on an order by the district court barring the other plaintiffs from filing papers, which was correct (they hadn't submitted their IFP materials), but the appeals court doesn't care.

A claim against the Department of Criminal Justice, Institutional Division, is barred by the Eleventh Amendment. See: Aguilar v. Texas Dept. of Criminal Justice, 160 F.3d 1052 (5th Cir. 1998).
