Colorado Coroner Entitled to Ambulance Reports
Nancy Bodelson, the Coroner for Jefferson County, Colorado asked the city of Littleton, Colorado for ambulance reports pertinent to the body she was autopsying. The city refused claiming that tae Colorado Open Records Act (CORA) Co. Rev. Stat. § 24-72-204 et seq., precluded such a disclosure. A Colorado trial court ordered the city to disclose the report, and the city appealed.
On appeal, the Court of Appeals of Colorado, Division 5, found that the CORA only precluded disclosure of medical records "unless otherwise provided by law." Since Colo. Rev. Stat. 30-10-606(6)(a) expressly provided otherwise, Div. 5 held the report to be disclosable and affirmed the trial court. See: Bodalson v. City of Littleton, 36 P.3d 214; 2001 (2001).
