Delaware FOIA Prohibits Disclosure of Records to Prisoner
The Supreme Court of Delaware has held that prisoners do not have a right to access their central files maintained by the Department of Corrections under the Delaware Freed of Information Act (FOIA). The Court held that 11 Del. §4322 specifically protects those records, and the FOIA does not repeal that statute because it specifically excludes “documents whose disclosure is otherwise prohibited by statute or common law.”
As such, the Superior Court’s denial of the prisoners’ mandamus petition was affirmed. See: Jenkins v. Gulledge, 449A. 2d 207 (1982 Del.).
