Ninth Circuit Explains Limitations on Police Beating, Prosecution Claims
The plaintiff's malicious prosecution claim did not accrue until his criminal charges were resolved favorably, and the limitations period did not begin to run until then. The statute began to run on his use of force claim at the time of the incident because a favorable resolution of it would not have implied the invalidity of the criminal charge or conviction. See: Cabrera v. City of Huntington Park, 159 F.3d 374 (9th Cir. 1998).
