Prisoner With AIDS Not Entitled to Snack of Choice

The failure of the defendants to provide the HIV-positive plaintiff with the brand name dietary supplement he wanted was not deliberately indifferent. He raised only a difference of opinion about medical treatment. Defendants provided him with appropriate medical attention, including dietary supplement in the form of night snacks. He did not lose weight during the period in question. See: Polanco v. Dworzack, 25 F.Supp.2d 148 (W.D.N.Y. 1998).
