Montana Public Defender's Deposition Subject to Public Scrutiny

The Billings Gazette, a Montana newspaper, sued in state court to compel disclosure of a deposition given by Yellowstone County's chief public defender, Sanford Selvey in connection with a civil action which resulted in Selvey's resignation as public defender. The trial court ordered disclosure with certain redactions, and the county appealed.
On appeal, the Supreme Court of Montana held that the deposition was subject to public scrutiny in its entirety. It therefore remanded with instructions for the trial court to order disclosure without redactions and to award appropriate attorney fees. See: Yellowstone County v.
