Nevada Railway Project Documents Exempt from Disclosure
The Reno Gazette-Journal (newspaper) sued the city of Reno, Nevada in state court to compel disclosure of documents associated with a railway's property acquisition and relocation. The trial court found that the state Public Records Act (PRA) Nev. Rev. Stat. § 342.105 mandated disclosure, and the city appealed.
On appeal, the Nevada Supreme Court found that under federal law, 49 CFR § 24.9(b) (2000) the requested documents were confidential. On that basis, the trial court was reversed. See: City of Reno v. Reno Gazette-Journal, 119 Nev. 55; 53 P.3d 1147 (2003).
