Kansas Prisoner not Consumer under State Consumer Protection Act

Nathaniel Ellibee, a Kansas state prisoner, sued the vender which provides meals for the state Department of Corrections (DOC) in state court under the state Consumer Protection Act (Act) because the vender wasn't providing kosher meals. The trial court dismissed because Ellibee gave nothing of value to the vendor, thus wasn't a consumer for purposes of the Act, and the appellate court affirmed. Sec: Ellibee v.
