Medical Review Committee Reports and Responses Exempt as Florida Public Records

Florida’s First District Court of Appeals has held that medical review committee reports and responses thereto are exempt from disclosure as a public record under §119, Florida statutes.

This action was brought by parties seeking such reports created during a class action lawsuit filed by Florida prisoners alleging unconstitutional conditions and medical care. The Court found the Florida legislature specifically made these types of records exempt. See: §766.101 (S), (7) (C).

As such, the trial court’s denial of the petition for word of mandamus and for declaratory judgment was properly denied. See: Tampa Television, Inc., v. Dugger, 559 So. 2d 397 (Fla 1st DCA 1989).
