$440 Awarded to Prisoner for Untimely Public Records Act Disclosure

On August 27, 2003, a Washington state prisoner was awarded $440 for untimely production of records in response to a public records act request.

Rick Young, a prisoner at Clallam Bay, asked for various records under the state public disclosure law from the Washington Department of Corrections (DOC), but the DOC did not respond in a timely manner. In fact, its response was 44 days late.

The court awarded Young $10 for each day the DOC was untimely in responding for a total of $440. See: Young v. Burt, No. 03-2-00654-1 (Sup Ct. State of Washington).
