Pennsylvania DOC Agrees to Pay $110,000 to Settle Sex Abuse Suit

On August 27, 2007, the Pennsylvania Department of Corrections (DOC) agreed to pay $110,000 to settle a lawsuit by a female prisoner who alleged that she was forced to perform sex acts on another prisoner while another guard watched.

According to 42U.S.C.§1983 complaint filed by Maria Rosado, Richard Kissinger, Jr., a guard of State Correctional Institution in Muncy, Pennsylvania coerced Rosado into performing various sex acts on another female prisoner while Kissinger watched. Rosado only agreed to perform the sex acts out of fear that Kissinger would prevent her parole or release to a community corrections center.

While Rosado would perform the sex acts, Kissinger would make “lewd and sexually demeaning comments,” Rosado’s complaint states. Rosado alleged that the Superintendent of the SCI Muncy was aware of Kissinger’s behavior but did nothing to stop him.

The DOC settled for $110,000. Rosado was represented by Jeffery Dohrmann of Williamsport, Pennsylvania.
