Toilet Tank Lid Ruled “Deadly Weapon”

A juvenile Court in Grant County, Washington, convicted a minor, D.A.C., of second degree assault after he threw a toilet tank lid at an employee of the Grant County Youth Services Detention Facility. D.A.C. appealed the assault conviction on the ground that the toilet tank lid was not a deadly weapon.

On appeal, the court determined the lid was easily capable of causing “substantial bodily harm” as it was used in this instance, and, therefore, was correctly characterized as a deadly weapon. See: Wash. v. D.A.C., Wash. App., Div. III, # 27866-2-III.
