$6,000 Settlement in Washington DOC Slip and Fall Suit

The State of Washington paid $6,000 to settle the lawsuit of Cherie Linn Sims for injuries sustained from a cracked sidewalk.

While walking down the sidewalk at Airway Heights Correction Center on October 27, 2003 around 8:30 p.m., Sims tripped and fell. She had caught her foot on a raised section of sidewalk that had a long crack in it, causing it to be about an inch and a half higher than the other piece. This area of sidewalk was poorly illuminated and could not be seen by a pedestrian negotiating it at this time of night.

Her complaint alleged negligence for failing to repair the cracked sidewalk, and improper lighting.

Sims accepted settlement on July 8, 2005. She was represented by Spokane, Washington Attorney Gregory G. Staeheli. See: Sims v. State of Washington, Superior Court, State of Washington, Case No. 04-2-02952-4.
