TDCJ Releases Hold on Prisoner's Trust Fund Account

In August, 2006, Texas prisoner, Michael Gene David, signed a settlement agreement dismissing all claims in a lawsuit he filed pursuant to 42 U.S.C. § 1983 against TDCJ employee, Howard Hill, for retaliation and harassment. Represented by attorney Andrew Lehrman of Anderson, Lehrman, Barre, & Maraist, LLP, David accused Hill of various abuses including verbal and physical abuse, filing false disciplinary reports, planting contraband in his cell, confiscating personal mail and arbitrarily freezing his trust fund account.

In the settlement agreement signed by both parties, TDCJ did not admit liability but agreed to release the hold on David's trust fund account in return for his dismissal of the suit.
