$35,000 Settlement in Personal Injury Negligence Suit Against California Department of Corrections
A California prisoner received a $35,000 settlement in a personal injury negligence suit. Prisoner Andre M. Smith was imprisoned at the California Men’s Colony on April 19, 2005. While getting off his bed, the chain broke and pinned his right leg beneath the bed. The complaint does not detail the extent of his injuries. After exhausting administrative remedies, Smith filed suit on May 16, 2006.
The case was settled on December 9, 2009 with payment to Smith and his attorney, Loren Nizinski for $34,122.17 and a payment of $872.83 to the state of California Department of Health Services.
