$20,000 Settlement in CCA’s Failure to Treat Tennessee Prisoner’s Ankle Injury

Corrections Corporation of America (CCA) paid $20,000 to settle a lawsuit alleging It failed to provide proper medical care for a prisoner at the Metro-Davidson County Detention Facility.

Marcie Thomas Warrick was arrested on January 22, 2003, as a result of a police pursuit that ended in the death of a motorist. She underwent extensive surgery on her feet and ankle at a hospital for the serious injuries she sustained in the accident.

CCA medical staff received specialized instructions for Thomas Warrick’s care, which include sterilization of the wound and the use of crutches. That care, however, was not provided. By march 18, her “wound had begun emitting a terrible odor.” Dr. Ramsey Walker refused to provide proper medical attention, and two of CCA’s medical staff decided she could not use crutches and required her to walk.

To gain proper care, Thomas Warrick broke the sprinkler in her unit. Responsible staff had her sent to a hospital, where she underwent a surgical procedure involving “removal of a portion and scraping of the bone in the infected areas,” states the complaint. She remained in intensive care from March 16 to May 15, 2003. At that time, she was released to CCA’s custody after the hospital’s effort to assure she received care at a mental facility was denied. She was released after a plea agreement was reached on August 8.

The March 2006 confidential settlement was obtained by PLN via public records request. Thomas Warrick was represented by Nashville attorney Edward J. Gross.
