$250,000 Settlement for Women’s Loss of Child in CCA Tennessee Jail

Corrections Corporation of America (CCA) paid $250,000 to settle a lawsuit claiming it provided inadequate medical care that caused her to lose her baby.

Unable to make bond on misdemeanor drug charge, Meredith Manning was placed into the custody of CCA run Metro Detention Center in Nashville, Tennessee. At her initial screening intake on June 29, 2004, it was discovered that Manning was two weeks pregnant. She complained of cramps at the time.

In response to cramp complaints on July 1, she was given Ibuprofen and told to increase her water intake. Manning again complained of cramps on July 5, and that complaint and a subsequent complaint resulted in no action. Despite being pregnant, she was forced to climb into a top bunk and was not provided extra food that is standard fare for pregnant women.

On October 18, Manning experienced vaginal bleeding, which a nurse demand “Proof” of to treat. The next day, she experienced bleeding, pain, and contractions. A nurse noted she was “Argumentative” after she was denied care. Later that day, Manning was given sanitary napkins. In the evening, she was moved to an isolation cell where the water was turned off to monitor her blood loss.

By 3 A.M. on October 20, the contractions intensified and the bleeding “Gushed” from her. She resorted to banging on the door for help. At around 7:00 A.M. she requested to be taken to a hospital, but that did not occur until after 8:50 A.M. Upon arrival at the hospital, it was recognized she was in labor. Her son born alive, but he died three hours later.

Manning, represented by attorneys Nathan S. Moore, James D.R. Roberts, and Janet Layman sued CCA. PLN is unable to verify when the settlement was reached.
