$199,000 Los Angeles County Settles Over Excessive Force Claim

The County of Los Angeles settled in June 2012 for $199,000 with plaintiff Carla Sameth after she filed a civil rights claim with the United States District Court against the Sheriff’s Department. Sameth was riding the Metro Gold Line Public Transportation System on December 28, 2009, when she was questioned by three county Sheriff’s Deputies as to whether she had a valid ticket. Unable to produce a ticket, she was told to exit the train at the next station. The deputies followed. Plaintiff became loud and argumentative. A female deputy initiated a cursory search of Sameth. Sameth resisted and in the process of pulling away from the Deputy hit her nose on a metal flange on a support pole. She was treated for a broken nose.

The Sheriff’s Department investigation concluded the actions undertaken by the three deputies were in compliance with Department policy and did not warrant corrective or disciplinary action. See: Sameth v. County of Los Angeles, U.S.D.C. (C.D. Cal.), Case No. 2:10-cv-06565.
