BOP Pays $50,000 in Trip and Fall Incident
The federal Bureau of Prisons paid $50,000 to settle a Federal Tort Claims Act that sought damages for injuries sustained during a trip and fall.
Janice West, 71, was entering The Federal Detention Center in Dublin, California, on July 8, 1995, to visit her son when she tripped on broken concrete near the front door.
She had bruises throughout her body, bruises to the chin, the right and left breast. She also sustained an injury to her right hand that required two surgeries and resulted in a permanent inability to grasp with that hand.
Represented by attorney Mary Coughin of San Francisco, West filed suit on September 4, 1996. The $50,000 settlement was reached on September 29, 1997. See: West v. United States, USDC, N.D. California, Case No 96-3210.
