LITIGATION ANALYSIS
The number of lawsuits filed in this quarter increased from the previous quarter, with 348
filed in the first quarter of 1995 and 413 filed this quarter. The amount of
awards/settlements in this quarter was more than in the previous quarter, with $5,150 in the
first quarter and $204,460 this quarter.
(Note that there was one large settlement of $130,000
for a wrongful death suit in MXR.) Although the total number of lawsuits and the dollar amount
of settlements was significantly greater this quarter than in the previous quarter, it is
premature to draw any conclusions from this data regarding litigation trends.

1995 QUARTERLY LITIGATION REPORT
SECOND QUARTER

Ie

SIGNIFICANT HEARINGS AND TRIALS

MID-ATLANTIC REGION
Shelton v. U.S., S.D. W. Va., FCI Alderson
Trial was held in Bluefield, West Virginia, on January 11, 1995,
in this FTCA case arising from salmonella food poisoning at FPC
Alderson.
Parr v. U.S., and Williamson v. U.s., S.D. Ind.,·USP Terre Haute
Separate telephonic trials were held before a Magistrate in these
FTCA property cases. In Parr the Magistrate found in favor of
plaintiff and awarded nominal damages in the amount of $10.00.
The ·Williamson case was decided in favor of the government.
These telephonic trials are being used when an inmate has been
transferred out of Terre Haute, and they seem to be working well.
Wood v. Hahn. et al., E.D. Va., FCI Petersburg
Plaintiff, seeking Temporary Restraining Order (TRO) to reinstate
telephone privileges, alleged that these privileges were
restricted for unauthorized use of the telephone (in conducting a
business) by the UDC without due process. On. Thursday, February
23, a hearing was held on the TRO. The government argued that
. plaintiff had failed to exhaust his administrative remedies and
that the "some facts" standard discussed in Hill should be
applied. The judge denied the request for the TRO. On April 3,
1995, an order was issued dismissing, without prejudice, all
defendants in their individual capacity.
NORTH CENTRAL REGION
Vashty st. Claire. et ale v. united states. et al., D. Ariz.
This hybrid Bivens/FTCA action has been previously reported.
Plaintiffs, representatives and survivors of former inmate Robert
st. Claire brought suit arising out of the circumstances
surrounding the death of Robert st. Claire. Plaintiffs, who are
not represented by counsel, sought four billion dollars
($4,000,000,000.00) in damages. On February 24, 1995, the
Complaint was dismissed for failure to properly serve the united
states.

NORTHEAST REGION
Meruelo v. Lamer, M.D. Pa.
Inmate Homero Meruelo, through counsel, filed a habeas corpus
petition challenging deferrals of his class placement at the
Intensive Confinement Center. The inmate had been removed from
the ICC program after the UDC found him guilty of various
infractions. The inmate's attorney amended his petition alleging
that the incident report was in retaliation for his habeas
action.
The magistrate held a hearing on January 6, 1995. On April 11,
1995, the judge dismissed the petition, holding that the ICC is a
"program" from which Petitioner can be removed on the basis of
disciplinary infractions.
Berman v. Lamer, E.D. Pa.
Inmate Jeffrey Berman, through counsel, filed a Bivens complaint
alleging staff at USP Lewisburg and FCI Fort Worth had been
deliberately indifferent to his medical needs and seeking an
order for an examination by a private specialist. The judge held
an emergency hearing on January 27, 1995,denied the motions from
the bench, and issued a decision resulting in the published
opinion at Berman v. Lamer, 874 F.Supp. 102 (E.D.Pa. 1995).
SOUTHEAST REGION
Ruble v. Anderson, N.D. Ga.
This is a Bivens action against five USP, Atlanta employees for
excessive force in a cell move. Requests for representation were
initially denied by the Department because the civil rights
division was conducting a criminal investigation into the
allegations. Grand jury proceedings on this matter are
progressing. All defendants are currently represented by private
counsel with no guarantee of government reimbursement. Both
sides have made a request for production of the video tape of the
forced cell move. The BOP is moving for a protective order which
would allow authorized representatives of both sides to view our
copy of the tape as often as is necessary but not to allow
possession of the" tape. A copy of the tape will be produced to
the court under seal.

u.s.

v. Timothy Hume, N.D. Ga.

This criminal prosecution involved an assault by an inmate with a
knife on a physician's assistant at Atlanta; it was tried on
January 24, 1995. The inmate's defense was that he was not
mentally responsible because BOP refused to supply prescription

drugs he had been previously taking. The jury rendered a guilty
verdict after 30 minutes of deliberation.
II. SETTLEMENTS

MID-ATLANTIC REGION
Brenda Liz Bermudez-Quinones v. U.S., N.D. W. Va., FCI Morgantown
The AUSA settled this wrongful death case for $130,000 without
first receiving permission to settle from the Bureau ,of Prisons.
This case involved the alleged failure of staff at FCI Morgantown
to prevent an inmate suicide in 1988. The case had a complicated
procedural history and we had already received one court order
where Judge Keeley had determined thpt prior 'to the suicide the
deceased was depressed and had received no mental health
treatment.
NORTHEAST REGION
Pitrone v. united States, N.D. Qhio
This wrongful death FTCA action was filed by the estate of
deceased inmate James Haddad. Haddad died on May 19, 1992, at
FPC McKean due to an apparent heart attack. No autopsy had been
ordered. Plaintiff alleged that FPC McKean medical staff failed
to diagnose and treat Haddad for congestive heart failure and
that staff failed to respond properly when Haddad suffered his
heart attack. Although the evidence showed that FPC McKean acted
within acceptable community standards, the judge placed a great
deal of pressure on the parties to settle the case. Plaintiff
had made a demand for over $1 million in damages. The United'
states agreed to settle for $20,000.
Wright v. united states, E.D. N.Y.
Former staff member brought this EEQ case alleging he was
terminated because of his race. Bureau records showed he was
terminated for cause. He alleged that the stress of working with
the Bureau caused medical problems which essentially disabled ,
him. After his termination, QPM granted Wright disability for a
work related injury. The case was settled by our agreement to
modify Bureau employment records to match QPM/s decision.
No
money damages were awarded to plaintiff. The government agreed
to pay attorney fees in the amount of $1500.

WESTERN REGION
Voto-Bernales v. united states. et ale
This case involved the amputation of the plaintiff's left
testicle. The matter has been tentatively settled for
$42,500.00, provided the tests show the plaintiff is still
fertile. The tests have been conducted and show significant
evidence of fertility. It should settle in the very near future.
PROPERTY SETTLEMENTS
Three lawsuits based on lost property were settled in the
Northeast Region for a total of $550.00.
III.CASES OF INTEREST
NORTH CEWI'RAL REGION
Warden, et al v. Perrill, et al., D. Colo., FCI

Englewood~

This case, which includes 11 current and former inmates at FCI
Englewood as plaintiffs, names 9 current and former employees of
FCI Englewood in a personal liability action seeking damages for
exposure to asbestos. The exposure is alleged to have occurred
in August, 1993 on a prison remodeling project. Varying degrees
of exposure to some of the inmates have been documented .in a
response to a Congressional inquiry and in an OIA investigation.
The plaintiffs are re'presented by counsel.
Wright, et ale v. Hawk, Kane, Edwards & Perrill, D. Colo., FCI
Englewood.
Like Warden, et ale v. Perrill, et al., this case involves Bivens
type allegations of constitutional deprivations caused by adverse
environmental exposure at FCI Englewood. A total of sixteen
similar pro se law suits have been filed, eleven of which have
been consolidated in 94-C-800. Unlike Warden, there is no
evidence indicating that any of these plaintiffs were exposed to
negative environmental substances at FCI Englewood.
Farmer v. Brennan, et al., W.O. Wis., FCIOxford.
On remand from the Supreme Court, the district court granted the
defendants' motion for summary judgment. Plaintiff has appealed
to the Seventh Circuit Court of Appeals and the Circuit has
appointed counsel for Mr. Farmer.

Dixon v. USA. et al., D. Kan., USP Leavenworth.
This is a problematic FTCA/Bivens case which alleges physical
abuse of inmates during a forced cell move. The defendants'
requests for legal representation have been forwarded to the
Constitutional Torts Branch. Because we anticipate a delay in
the representation decision, the united states Attorney has filed
for another extension of time.
Weeks v. USA, D. Kan., USP Leavenworth
The plaintiff in this FTCA case alleges he was physically abused
during the same forced cell move of which inmate Dixon complains.
An answer is due in early May and it is anticipated that numerous
jurisdictional defenses will be asserted.
Howard v. United states, D. Colorado civil No. 92-N-1515
In November, 1994, Judge Nottingham issued a temporary injunction
directing the FCI Englewood staff to permit inmate Howard to
perform rituals of the Church of Satan at reasonable times and
places. Pursuant to this order, inmate Howard has been permitted
to perform monthly rituals. The government filed a motion for
reconsideration which the court took under advisement.
On March 13, 1995, the U.s. Attorney filed a motion with the
court advising that inmate Howard had violated prison rules by
participating in a serious assault of another inmate. One of the
sanctions was a recommended disciplinary transfer. At a March
30, 1995 status conference, counsel for Mr. Howard requested that
Judge Nottingham enter an appropriate order compelling the BOP to
keep inmate Howard within the jurisdiction of the court. The
court declined to do so. The court is considering taking oral
testimony on the government's motion to reconsider. A status
conference is scheduled for Friday, April 14, 1995 at 2:00 p.m.
MDT in Denver, Colorado.
SOUTH CENTRAL REGION

McAlpine v. Thompson. et al., W.D. Okla.
This is a case in which a Native American inmate has sued for the
right to use peyote in his religious ceremonies. The Magistrate
Judge has issued a Report and Recommendation recommending
dismissal of the suit. We are awaiting a final ruling from the
District Judge.
Turner v. Wooten, W.D. Tex.
This is a Bivens case, involving allegations that the plaintiff
was forced to work in deliberate indifference to his serious
medical needs. This case has a long and tortured history,
complicated even more by the fact that Dr. Garrett Duckworth, one

of the named defendants, has filed for bankruptcy. Dr. Duckworth
has named all codefendants, and AUSA Robinson, as potential
creditors in his bankruptcy. AUSA Robinson has withdrawn from
the case since being named a defendant and constitutional Torts
Branch is taking over the case. Trial is currently scheduled for
mid-May, in El Paso, but the government is moving for a
continuance to conduct discovery. We are also working with the
constitutional Torts Branch to obtain representation for the
defendants in Dr. Duckworth's bankruptcy, to protect their right
to contribution on the off chance that the defendants are found
'liable to the plaintiff.
SOUTHEAST REGION
Olson. et ale v. Federal Prison Industries (UNICOR), et al., S.D.
Ga.
Mandamus case which involves FC! Jesup inmates alleging that the
UNICOR Board of Directors received unauthorized gifts, UNICOR
employs illegal aliens and pre-trial detainees, UNICOR sells
goods to private companies, UNICOR threatened and coerced inmates
to work in UNICOR for less than minimum wages, and that inmates
are transferred repeatedly to prevent a raise in pay. On March
6, 1995, the Magistrate recommended dismissal because no special
grand jury had been impanelled in this district and therefore,
the inmates had no basis for their mandamus action.
WESTERN REGION
Low v. Taylor, C.D. Cal.
In this suit under the Religious Freedom and Restoration Act, a
Satmar Hasidic Rabbi seeks injunctive relief regarding a variety
of religious issues, including an appropriate. diet, providing a
mikvah, a minyan, and an appropriate Torah. Both the district
. court and the Ninth Circuit refused emergency injunctive relief
and required petitioner to exhaust his administrative remedies.
The Court of Appeals has set an expedited appeal schedule with
Appellant's Brief due April 24, Appellee's Brief due May 24, and
oral argument in July, 1995.

Collazo-Leon v. Bureau of Prisons, 94-2061 (1st Cir.)
Challenge by pretrial detainee at MDC Guaynabo to DHO discipline
as being unlawful; oral argument held February 10, 1995, in
Boston, Mass.; decision favorable for Bureau on April 7, 1995.

SETTLEMENTS
Second Quarter
Western Region
Ter.ms.
The complainant alleged discrimination against the
Federal Correctional Institution, Terminal Island, California, on
the basis of national origin (Puerto Rican), sex (female), and
that she was subjected to sexual harassment when staff made
unwelcome comments toward her and she was terminated from her
position as Cook Foreman. The complaint of discrimination was
settled on January 29, 1995, prior to completion of the EEO
investigation. The settlement agreement provided that management
change the complainant's termination (Standard Form 50) to
resignation; when employment requests from prospective employers
are received, management will state only that the complainant
resigned for personal reasons; all documents relating to the
complainant's termination will be removed/destroyed from her
official personnel folder; and the complainant would not apply
for employment with the Bureau for a two-year period.
Reason for Settlement. The complaint was settled by the EEO
Investigator through factfinding/mediation.
Northeast Region
Ter.ms. The complainant alleged discrimination against the
Federal Correctional Institution, Ray Brook, New York, on the
basis of his sex (male) when he received a five-day suspension
and was the subject of an internal investigation. The settlement
provided that the employee's reckoning period for the
disciplinary action be shortened to a fourteen-month period.
Reason for Settlement. The complaint was settled by the
assigned EEO Investigator through factfinding/mediation.
South Central Region
1.
Ter.ms.
The complainant alleged that he was discriminated
against because of his national origin (Hispanic) and in
retaliation for filing prior complaints of discrimination when
his supervisors improperly investigated him by requesting
memoranda from co-workers regarding his ability to get along with
staff and inmates. This complaint was settled on January 18,
1995. The complainant will meet with management to discuss how
his work environment has been affected. Management will ensure
that Mr. Lopez is allowed to work in the same work environment as
other st·aff without fear of reprisal.

Reason for Settlement. This complaint was settled by the
assigned EEO Investigator through factfinding/mediation.

Ter.ms. The complainant alleged discrimination against the
Federal Correctional Institution, La Tuna, Texas, on the basis of
his race (white) and sex (male) when he was not selected for
supervisor of the year. The settlement agreement provided that
management assist him in seeking reassignment/promotion at
another facility.
Reason for Settlement. The complaint was settled by the
assigned EEO Investigator through factfinding/mediation.

We are pleased to provide the CRIPA Quarterly Activity Report for
the period of January I, 1995, through March 31, 1995.
JURISDICTIONS CERTIFIED
No jurisdictions were certified this quarter.
PENDING APPLICATIONS
Clinton County, Pennsylvania - We received their application for
conditional certification on January 12, 1995. A formal review
of the application has been completed. We have provided their
staff with our suggestions for modifications to their procedure
to comply with regulations.
County of Bucks, Pennsylvania - On February 27, 1995, we received
their application for full certification. Bucks County had been
granted conditional certification for one year on December 8,
1992. We reviewed their evidence of past performance, and have
recommended full DOJ certification be granted.
Michigan Department of Corrections - We have received the final
draft policy which incorporates our suggested modifications, and
we are now only awaiting their Spanish translation in order to
recommend full certification.
Hawaii Department of Public Safety - No ochange from last quarter.
We are still awaiting a response to our suggested modifications
to their application for full certification.

Fulton County Jail, Georgia - There is no change in status from
last quarter. We are still awaiting their response to the
comments and suggestions made in our formal review of their
application for certification.
INFORMAL REVIEW
South Carolina Department of Corrections - An informal review of
their grievance procedure was conducted the week of March 11,
1995. We made several suggestions to assist in the certification
process.
CORRESPONDENCE
Rhode Island Department of Corrections - We continue to provide
advice and assistance to Rhode Island in the development pf A
certifiable grievance procedure.
We are beginning to receive FOI requests for CRIPA documents.
Also, we continue to receive correspondence from inmates and
other parties interested in CRIPA.
ACCOMPLISHMENTS
On March 15, 1995, an interim rule was published modifying CRIPA
regulations to conform with changes outlined in the 1994 Crime
Bill. The changes include an increase from 90 to 180 days for
the time allowed for exhaustion of remedies, and a provision for
certifying jurisdictions demonstrating a "fair and effective"
grievance procedure.
During the quarter, the National Inmate Appeals section prepared
a CRIPA Question and Answer briefing paper to DOJ through the
Bureau's Office of Public Affairs. This information was to be
used by the Attorney General for a meeting with state Attorneys
General.
STRATEGIES
We will be updating our CRIPA handbook to include changes in the
law and regulations as previously referenced. We notified
jurisdictions with pending applications of these changes.
