Synopsis of Complaint: On 6/20/ 19, at approximately 8:29 AM the Professional Standards Bureau received
an e-mail from
gmail.com reportng a marked Troop car (2F84) parked unattended with the
engine running containing a K-9 that barked consistently between 7:00 AM and 8: 15 AM . The author of the
e-mail claims that the Trooper that operates the vehicle is visiting a- - - that resides in the
apartment complex. The author also claims that this is the fourth or fifth time that this has occurred.

I have reviewed the attached report and agree it is founded. Trooper Missale violated
Division Rules and Regulations, specifically Regulation 8A3: It shall be the duty of all Members to
obey lawful order issued orally or in writing by Competent Authority. He also violated Regulation
8A8(2): A Member shall not act in a manner tending to bring discredit upon the Division.
Recommend appropriate administrative action at Troop level. Forwarded for your
review.

Reference is made to Complaint Against Personnel #20190210 and corresponding
Gen) 30 cover page report dated September 3, 2019 of Lieutenant CHRIS N. FLOCATOULAS. I
have reviewed Lt. FLOCATOULAS' report and find it properly investigated and submitted.
On June 20, 2019, the Professional Standards Bureau received an email regarding a
K-9 member and his partner. The complainant stated the K-9 was left in a marked police vehicle for
an extended period of time and woke up herself or o1hers in her apartment. The complainant also
went on to state this has happened in the past.
Investigation into this matter found Trooper STEVEN J. MIS SALE did in fact stop at
residence at
, NY on June 20111 and left
his K9in the vehicle. Trooper MISSALE states he heard his K9 barking and attempted to address the
matter, and left the apartment complex when his K9 continued to bark. The allegations that this
happened several times in the past was not able to be confirmed. The complainant has been
uncooperative and failed to recontact after numerous requests from State Police personnel.
However, the State Police A VL records show that Trooper MISSALE did spend an inordinate
amount of time at
residence on the following four days: 5/29119. 5/30/19,
5/31/19 and 6/10/19. Trooper MISSALE was instructed by Sgt/SC ARTHUR WORDEN JR on
3/28/19 not to remain at
residence for extended periods that lasted longer than
the allotted meal time period as stated in the PBA Agreement- Article 12.29.
During the course of the investigation, it was determined Trooper MISSALE did
violate the NYSP Rules or Regulations, specifically Regulation 8A3 and 8A8(2).
Accordingly, this complaint against personnel is Classified/Founded with appropriate
administrative action recommended.

SYNOPSIS:

On 6/20/2019, the Professional Standards Bureau (PSB received an email from
a person named - - with the email address

her home. A preliminary check by PSB of LATS and AVL records for 6/20/2019,

By all accounts, this administrative investigation has corroborated that Trooper
MISSALE's K9 partner did in fact bark while in 2F84 on the morning of 6/20/2019,
outside o f - residence. There is no evidence to support, the totality of
the a d d i t i ~ a d e by

numerous times prior lo 6/20/2019. The complainant- has failed to cooperate
with the investigation, after several attempts to schedule an interview by both myself
and PSB. This investigation found that, in disregard to a direct station order, Trooper
MISSALE spent an inordinate amount of time at
residence,·
specifically on 5/29/2019, 5/30/19, 5/31/19, and 6/10/19.
It is recommended that this case be closed as FOUNDED with appropriate
administrative action to be taken.
DETAILS:

AT SP MONROE
1.
On 6/20/2019, I was notified by Acting-Troop Commander Captain MICHAEL J.
DRAKE of a personnel complaint against Trooper STEVEN. J . MISSALE (F-SP
Montgomery). It was alleged Trooper MISSALE parked his assigned Division Vehicle
2F84, unattended with engine running in an apartment complex on 6/20/2019, while his
K9 partner barked consistently between 7:00am and 8:15am. It was also alleged this
was the fourth or fifth time this barking has occurred, wh~MISSALE was

correspondences from Staff Inspector GREGORY are attached as enclosures# 2 and

On 6/20/2019, I reviewed the AVL captures provided by PSB, which revealed
Trooper MISSALE was parked in an a artment com lex named

a total of 17 times, on 13 different dates. The AVL

On 6/20/2019, I was instructed by my Zone Commander, Captain JENNIFER H.
GOTTSTINE to order Trooper MISSALE to stop parking his !<9 Division vehicle 2F84 at
t h ~ apartment complex, while on-duty, unless there was a legitimate
c a l ~ at that location. I contacted Trooper MISSALE by phone and
conveyed the order, which he acknowledged. He stated he was visiting at her residence.

On 6/25/2019, I contacted Captain LAWRENCE A. MULLER (H-PSB) and he
informed me t h a t - never responded to PSB's earlier request (6/20/2019) for
contact information.

but not hours at a time. Trooper MISSALE believed he mostly complied with
Sergeant/SC WORDEN's orders, however he believed there were 2 occasions when he
spent more than an hour at her residence following the c o m p l ~
assignment: On 5/31/2019 Trooper MISSALE believed he stayed a t residence in excess of one hour but could not remember the times; And, on 6/10/2019
he believed he was at her residence from 2:00pm until 9:30pm. ~

period of AVL captures (4/1/2019 to 6/20/2019) and they are attached as enclo~ure # 9.

On 6/28/2019, I interviewed SergeanUSC ARTHUR WORDEN Jr; who stated he
had a meeting with Trooper MISSALE~ a r d i n g him spending extended
periods of time at the residence of 111111111111111 while on duty. SergeanUSC
WORDEN told Trooper MISSALE to discontinue the practice and adhere to the 45minute meal period time allotted during the 12-hour duty tour, as referenced in the PBA
Agreement-Article 12.29. Trooper MISSALE acknowledged and agreed to abide by it.
SergeanUSC WORDEN's memorandum is attached as enclosure# 10.

This administrative investigation has revealed that from 4/1/2019 to 6/20/2019,
Trooper MISSALE visited
residence a total of 17 times on 13
different dates, while on-duty in a Division Vehicle. The AVL captures showed the
duration of each visit varied; as short as 1 minute to as long as 6+ hours .
. Neither Trooper MISSALE, nor
ave ad any personal contact with any neighbor at
regarding Trooper MISSALE's K9 partner barking outside her residence.
By all accounts, this administrative investigation has corroborated that Trooper
M I S S A L E ' ~ n fact bark while in 2F84 on the morning of 6/20/2019,
outside o f - residence. There is no evidence to support, the totality of
the additional allegations made by
that Trooper MISSALE's K9 barked
numerous times prior to 6/20/2019. MS.
has failed to cooperate with the
investigation after several attempts to schedule an interview by both myself and PSB.
This investigation found that, in disregard to a direct o r d e r ~ WORDEN,
Trooper MISSALE spent an inordinate amount of time a t - residence,
specifically on 5/29/2019, 5/30/2019, 5/31/2019, and 6/10/2019.
This investigation has determined that Trooper MISSALE violated · the following
regulations of the New York State Police:

Regulation 8A3: It shall be the duty of all Members to obey every lawful order
issued orally or in writing by Competent Authority.

Trooper MISSALE disregarded an order from Sergeant/SC ARTHUR WORDEN Jr. to
discontinue spending more time than a single meal period (45 minutes) at apartment during work-time hours. On 05/29/2019, Trooper MISSALE spent

apartment during two visits. On
5/30/2019 Trooper MISSALE spent a total of 2 hours 44 minutes at her residence during
two visits. On 5/31/2019, Trooper MISSALE spent a total of 2 hours 28 minutes at
apartment during two visits. On 6/10/2019, Trooper MISSALE spent
~ 2 0 minutes at her residence during a single visit, 2 hours 13 minutes
of which were during work hours (even though last 4 hours 7 minutes were in an offduty capacity, his marked Troop car was parked outside her apartment the entire time).
Regulation 8A8(2): A Member shall not act in a manner tending to bring discredit
upon the Division.
Trooper MISSALE displayed unprofessional conduct by parking his marked Troop car
outside apartment in an apartment complex during duty hours 17
times i n ~ and 6/20/2019. On a few of these occasions it was alleged
that Trooper MISSALE's K-9 partner was left barking inside the vehicle. Actions such
as this provide for a bad public perception as exhibited by the email penned b y (enclosure# 1).
