Class Certification in Texas Jail Court Access Case

The Fifth Circuit Court of Appeals reversed a U.S. District Court for the
Western District of Texas that refused to grant class certification of a
suit brought by indigent prisoners of the Bexar County Jail in Texas
regarding the inadequacy of the law library because the Federal Supplement
is absent. The court said the improper denial of class certification
requires that they again reverse and remand so that the district judge may
be able finally to consider or determine the merits of the plaintiffs'
claim. See: Cruz v. Hauck, 627 F. 2d 710 (5th Cir. 1980).
