Anesthetized Prisoner Awarded $500 for Fall and Injuries

A New York prisoner who was injured when he fell while under effects of anesthesia was awarded $500.

On January 13, 1999, New York prisoner James Siena underwent general anesthesia for a kidney procedure. After discharge, "he became dizzy while climbing stairs and fell backward down numerous steps." He was handcuffed and injured his back and ribs. He was taken to the emergency room for his injuries.

Siena sued in state court, alleging that he was prematurely discharged and transport officers were negligent. On September 19, 2005, the court dismissed the premature discharge claim, but found the transport guards negligent and awarded Siena $500 with interest for past pain and suffering. See: Siena v.
