Fatal LAPD Arrests Show Systemic Failure in Handling Mental Health Crises

by Jo Ellen Knott

Graphic footage documenting the deaths of two men undergoing mental health crises in Los Angeles Police Department (LAPD) custody has exposed pervasive failures by law enforcement to humanely handle arrestees following established guidelines and training.

On July 15, 2026, LAPD officers arrested Jose Carlos Hoyos-Munoz, 58, during a psychiatric episode. Despite family pleas to take him to a hospital, police transported him to a San Fernando Valley jail. Video footage depicts guards forcefully holding Hoyos-Munoz down, placing a “spit sock” over his head, and swarming him as he stood cuffed behind his back on a cell toilet. Multiple guards wrestled him face-down onto a cot in a prone restraint, a maneuver linked to positional asphyxia and explicitly banned under 2021 California law when it restricts breathing. Guards backed away from his motionless body, and he was pronounced dead shortly thereafter.

Two weeks later, on July 29, officers confronted Alejandro Luis Garcia, 33, who was experiencing a mental crisis while swinging an aluminum bat on a sidewalk. Disregarding de-escalation protocols designed for severe emotional distress, officers opened fire within seconds of shouting commands, fatally shooting Garcia.

Despite city policies mandating 40 hours of mental health intervention training and strict prohibitions against positional asphyxia, LAPD personnel completely abandoned humane restraint procedures and de-escalation tactics. While the fatal encounters are under internal and prosecutorial review, as of late September 2026, neither case has resulted in publicly announced criminal prosecution or disciplinary punishment of the involved LAPD officers.
