Assaulted New York Jail Prisoner Awarded $330,000

In October 1998, a New York court awarded $330,000 to a man who was
seriously injured in an attack by other prisoners at a Westchester County jail.

The plaintiff claimed that while imprisoned by Westchester County in
September 1992, he was moved from a minimum to a maximum security jail
without explanation. Upon arrival at the maximum security jail the
plaintiff, 42, was attacked and beaten by other prisoners.

The plaintiff alleged in his lawsuit that the jailer was negligent for not
returning prisoners to their cells before admitting him to the cellblock
and for failing to summon help once the attack began. The plaintiff claimed
he suffered a septal perforation, a deviated septum, nasal fractures, and
emotional distress as a result of the attack. See: Zucker v. County Of
Westchester, Court of Claims, Case No. 22182/93, 1998 WL 952957.
