Seizure of MO Escapee's Prison Account Upheld

The Missouri Court of Appeals upheld the confiscation of a state
prisoner's trust fund account after he escaped from work release and
remained at large for a month. The defendant prison officials claimed he
abandoned the funds when he escaped. The trial court granted the
defendants summary judgment in the replevin action brought by the
prisoner, which was affirmed on appeal. See: Wilson v. Schriro, 952 S.W.2d
806 (MO Ct. of Appeals, 1997).

[12] While in the custody of a work release program, Wilson escaped and remained at large for one month. While at large, his inmate accounts were confiscated because of his abandonment. Wilson filed a replevin action against respondents requesting the return of his money some twenty months after his escape. Defendants moved for summary judgment against Wilson and summary judgment was granted in their favor.

[13] Judgment affirmed. Rule 84.16(b).
