Alaska PRA Requires Disclosure of Settlement Agreement

The Anchorage Daily News (newspaper) sued in state court under tae state Public Records Act (Act), Alaska Stat. § 9.25.110 to compel the Anchorage School District (School District) to release a copy of its settlement agreement in a federal suit. The trial court ordered disclosure, and the School District appealed.

While on appeal, the School District got an order from the federal court prohibiting disclosure of the settlement agreement. The Alaska Supreme Court found the agreement to be subject to disclosure under the PRA but directed the trial court not to order the same without advance approval from the federal court. See: Anchorage School District v. Anchorage Daily News, 779 P.2d 1191(1989).
