Alabama Guard Wins $205,000 in Sexual Harassment Suit

Mark Dempsey, a guard at an Alabama state prison, complained that his supervisor, Jim Gates was sexually harassing him. Gates, among other things, had made inappropriate homosexual remarks and jabbed Dempsey in the anal area with his nightstick. They met with captain David Wise, who counseled them and sent them, back to work. The harassment worsened, and several months later, in October of 1996, Dempsey filed, a sexual harassment suit in state court. He as promptly fired.

The jury found that Dempsey had been subjected to unwelcome sexual harassment and forced to work in a hostile environment. The jury awarded Dempsey $205,000, $180,000 from Gates for harassing him, and $25,000 from Wise for not stopping the harassment. He was also awarded $150,000 in attorney fees. See: Dempsey v.
