Pierce County Washington Unlawful Imprisonment Results in $5,000 Settlement

Washington State’s Pierce County Jail paid $5,000 to settle an unlawful imprisonment claim. On March 14, 1999, Binh Thai Nguyen was arrested in Cowlitz County and booked in the Pierce County Jail. Nguyen was released on March 16, 1999, because the arrest warrant was for Binh Hoa Nguyen.

Nguyen was again arrested on May 5, 2001: this time by Clark County. He was once again transferred to the Pierce County Jail and held until June 1, 2001. Fingerprints verified that he was not the same Nguyen sought by the warrant.

For his claim of mistaken identity, Nguyen sought damages for loss of earnings, mental stress, emotional damages, embarrassment and fear. Pierce County settled the claim on April 18, 2005. Nguyen was represented by Seattle attorney Michael E. Blue.
