Washington State Settles Wrongful Imprisonment Claim for $5,000

On November 16, 2006, the State of Washington settled a wrongful imprisonment claim against the Department of Corrections (DOC) for $5,000.

Mario Garcia was convicted of burglary and assault and sentenced to 21 months imprisonment and 9-18 months of supervised release. The DOC incarcerated Garcia once for at least 75 days and a second time for 40 days for violating the conditions of his community custody. However, the first incarceration extended beyond the end of his sentence and the second was imposed after his sentence had expired.

Garcia filed a claim for the wrongful imprisonment. The claim was settled for $5,000. Garcia was represented by Spokane attorneys John C. Perry and Richard D. Wall.
