Class Certification of Dental Claims against Cook County Denied

U.S. District Judge Harry D. Leinenweber denied class certification to a group of current and former pretrial detainees suing the Cook County Jail for inadequate dental care.

Vincent Smith and several other current and former Cook County pretrial detainees sued Cook County claiming the denial of timely and adequate treatment for dental pain. The plaintiffs moved for class certification, but the court denied the motion.

The plaintiffs’ claim lacked commonality and typicality, the court held. Each of the plaintiffs’ claims was fact dependent, the court explained. “[W]hile some issues would be common, many would not and no case would be typical,” the court held. See: Smith v.
