California Prison Sexual Harassment Case Settles for $210,000

The California Department of Corrections and Rehabilitation (CDCR) has paid a former contract employee $210,000 to settle her claims of sexual harassment, discrimination and retaliation.

Lakesha Jones worked as a registry Licensed Vocational Nurse (LVN) for the CDCR from August 2006 to August 2007. During that time her supervisor, Dominque Yeboah, allegedly sexually harassed her. Even so, Jones later applied for a permanent LVN position but was not selected. The CDCR ended her registry LVN position in August 2007.

Jones sued Yeboah and the CDCR in state court alleging sexual harassment, quid pro quo sexual harassment, unlawful retaliation, sex discrimination, failure to prevent and remedy sexual harassment, and constitutional violations under 42 U.S.C. § 1983.

A mediation hearing was held on January 18, 2010, and nine months later the parties entered into a Settlement Agreement and Release of Claims. Under the terms of the Agreement, the defendants did not admit any wrongdoing but agreed to pay Jones $210,000.

Jones agreed to waive any further claims related to "her failure to obtain a permanent or limited term position ... or her alleged sexual harassment by Mr. Yeboah." She also agreed "that she shall not in the future apply for or otherwise seek employment with the California Department of Corrections and Rehabilitation, or any of its subdivisions, facilities, hospitals, medical departments, or offices, including through a Registry, nor will she ever again accept employment with California Department of Corrections and Rehabilitation, including work through a Registry."

Yeboah agreed to waive any defamation, malicious prosecution or other wrongful conduct claims against Jones related to her allegations of sexual harassment and improper conduct regarding her efforts to seek a permanent position with the CDCR.
