$175,000 Settlement in Excessive Force Suit by Los Angeles Deputies

$175,000 Settlement in Excessive Force Suit by Los Angeles Deputies

The County of Los Angeles paid $175,000 to settle a lawsuit alleging excessive force by deputies upon a prisoner.

Alejandro Alarcon was arrested in the early morning hours on April 10, 2010, for driving under the influence. He was booked into the Los Angeles County Sheriff’s Department’s Inmate Reception Center. During his initial search, Alarcon became involved in a physical altercation with two deputies.

Alarcon’s claim alleged the deputies used excessive force upon him; the deputies claimed the force was necessary to overcome Alarcon’s resistance. Los Angeles County settled the subsequent lawsuit filed by Alarcon to avoid the “risks and uncertainties of litigation,” which would include an award of reasonable attorney fees if Alarcon prevailed at trial.

The Los Angeles Board of Supervisors’ agenda took the matter up for vote in December 2012. Alarcon was represented by attorney Darren A. Namibog. See: Alarcon v. County of Los Angeles, Los Angeles Superior Court, Case No. BC458777
